EZlinkPlus Terms and Conditions

Upon activation of service, you agree to accept our Terms and Conditions when you activate service. You can read a current version on our website www.EZlinkPlus.com or request a copy or hear the terms by calling customer service at (877) 327-6691. You may refund your EZlink card if you do not find these terms acceptable. You may not obtain a refund, change or transfer the service once your card is loaded (or PIN redeemed). The following information is accurate as of the date below. The current Terms and Conditions on the website govern in the event of any conflicts.

Charges and Features:
You will be charged Anytime Minutes for incoming and outgoing voice calls, Text (SMS) messages and other features. Voice calls are rounded up to the next full minute. Voice calls during the Peak Calling Period will be charged one Anytime Minute for each minute used, plus one additional Anytime Minute, plus the charge of any feature used, as listed below. Voice calls during Nights and Weekends are not charged, unless the call involves a chargeable feature. Text (SMS) Messages are charged one Anytime Minute for each Text (SMS) Message sent or received, plus the charge of any feature used. The following is a list of EZlinkPlus features and the related additional charges:

Domestic Long Distance is included without additional charge during Peak Calling Periods. Calls during Nights and Weekends are charged one additional Anytime Minute for each minute used. Domestic Long Distance means calls that both originate and terminate in the continental United States.
International Long Distance calls are charged forty additional Anytime Minutes for each minute used. This feature is generally not available.
Off Network Roaming calls are charged three additional Anytime Minutes for each minute used. This feature is generally not available. Text (SMS) Messages sent or received during the Peak Calling Period are charged three additional Anytime Minutes for each.
Information/Directory Assistance (411) calls are charged an additional twenty Anytime Minutes.
Operator Assisted calls are charged 100 additional Anytime Minutes for each minute used.
Party/Chat line calls are charged an additional one Anytime Minute for each minute of use during nights and weekends.
Call forwarding calls are included without additional charge. You are responsible for any taxes or surcharges.

Minimum Balance:
You must maintain a minimum balance of ten Anytime Minutes and one Access Day to avoid service suspension. Calls or average usage that will reduce or are likely to reduce your Anytime Minutes below the minimum balance will result in suspension of your service. Upon loading another EZlinkPlus product that brings your account balances above the minimum balances, your service will be restored with no extra fees, and any unused Anytime Minutes will carryover. Anytime Minutes that are not used within 120 days from initial load will be forfeited. If your account is suspended for more than ten consecutive days due to insufficient Anytime Minutes, or due to insufficient Access Days, your service will be disconnected. Upon disconnection, your Anytime Minute balance, Access Days balance, and phone number will be forfeited.

Restrictions & Limitations:
Night & Weekend calling is available from 9 p.m. – 7 a.m. Monday through Thursday, and from 9 p.m. Friday to 7 a.m. Monday local time for local calls within the Home Calling Area only. Hours other than Nights & Weekends are considered the Peak Calling Period. Unattended calls, “party/chat line” calls, three-way calls, call waiting, off network roaming and calls involving features listed above are not included in Nights & Weekends and are chargeable. Three way calling, caller ID, Text (SMS) Messaging, operator assisted calls, and other features may not be available on your handset or in your calling area. Calls to certain telephone numbers or regions may be restricted (including calls to 500, 700, 900 or 976 numbers). Your handset (including the subscriber identity module or “SIM”) will be restricted to EZlink services enabled by DBS Communications, Inc. (DBS), and cannot be activated on any other wireless service. You agree not to tamper with or alter your handset or its software, enter unauthorized PIN numbers, or engage in any other unauthorized or illegal use.

Service Cancellation, Limitation of Liability and Other Terms:
Your service, and account balance, may be refused, suspended or cancelled with or without notice for reasons of illegal activities such as fraud or theft of services, or if we in our sole discretion believe that you have violated these Terms and Conditions or our policies, or cannot pay any charges for service, or for prohibited uses (including without limitation excessively long or unattended calls or series of such calls, or calling destinations not explicitly allowed by the EZlinkPlus card or using equipment that may interfere with our network or service to customers), or for utilizing the service for other than for its intended purpose. EZlink services may be used only for voice and not data calls. Examples of prohibited uses include, without limitation, using the services in connection with a computer, or party-line type use, during Night and Weekend hours. We reserve the right to offer a different calling plan, or not to authorize a new card for additional services for a subscriber number that involves excessive or prohibited use (use of more than 2,000 Night and Weekend Minutes over a 14 consecutive day period is a prohibited use ). Cards which are not loaded within six (6) months of purchase will be forfeited and DBS will not be liable for any services. Service rates, minute denominations, additional fees and other terms are subject to change without notice at our sole discretion. The Terms and Conditions of other EZLink products may apply or supersede these Terms and Conditions. Other restrictions apply. The coverage map is an approximation of coverage, and actual wireless coverage may not be available in all areas within the coverage map. Your wireless services may be affected by network outages and weak signal conditions, and will not be available in all locations or at all times. DBS shall not provide any credit for dropped or interrupted calls. DBS may use any carrier to provide services and may change any of its service providers without notice.
DISCLAIMER OF WARRANTY: DBS DOES NOT WARRANTY SERVICE BY THE CARRIER AND SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES CAUSED BY SERVICE OUTAGES ON THE CARRIER’S SYSTEM. DBS SHALL NOT BE LIABLE FOR ANY CLAIMS RELATING TO ANY SERVICES NOT PROVIDED BY DBS AND PRODUCTS NOT MANUFACTURED BY DBS. DBS is not responsible for lost or stolen cards, or unauthorized use of services described on the card, or for any interruption of telecommunications services. If your phone is lost or stolen, please visit the nearest retail location to have your phone suspended temporarily. DBS LIMITS ITS LIABILITY TO THE FACE VALUE OF THIS CARD IN THE EVENT YOU SUFFER ANY LOSS OR DAMAGES AS A RESULT OF ANY ACT OR OMISSION BY DBS OR AS A RESULT OF THE BREACH OF THESE TERMS AND CONDITIONS.
We may contact you on your EZlink wireless phone, by e-mail, or by telemarketing or direct mail to notify you when your balance is low and to inform you of product and promotional offers and awards of DBS. EZlinkPlus is provided only by DBS and its authorized agents.
Resolution of Disputes: All disputes between you and DBS, including issues of arbitrability, shall be settled by binding arbitration under the rules of the American Arbitration Association including its Wireless Industry Arbitration and it Supplementary Arbitration Rules. All claims shall be arbitrated individually and there shall be no consolidation or class treatment of any claim unless previously agreed to by DBS. Both you and DBS waive any trial by jury.
