Terms and Conditions
Upon activation of service, you agree to accept our Terms and Conditions. The current version can be accessed on our website, www.EZlinkVIP.com or you can obtain a copy by calling customer service at (877) 327-6691. The following information is accurate as of the date below, but the current Terms and Conditions govern in the event of any conflicts.
Charges and Features:
You will be charged Anytime Minutes for incoming and outgoing voice calls, Text (SMS) messages and other features. Voice calls are rounded up to the next full minute. Voice calls during the Daytime Calling Period will be charged one Anytime Minute for each minute used, plus one additional Anytime Minute, plus the charge of any feature used, as listed below. Voice calls during Unlimited Nights and Weekends and with an Unlimited Daytime product are not charged, unless the call involves a chargeable feature. The following is a list of EZlinkVIP features and the related additional charges:
- Domestic Long Distance calls are included without additional charge. Domestic Long Distance means calls that both originate and terminate in the continental United States.
- International Long Distance calls are charged forty additional Anytime Minutes for each minute used; except for Canada which is charged nine additional Anytime Minutes for each minute used, and for the Caribbean which is charged twenty-five additional Anytime Minutes for each minute used. This feature is generally not available.
- Off Network Roaming calls are charged three additional Anytime Minutes for each minute used. This feature is generally not available.
- Information/Directory Assistance (411) calls are charged an additional sixteen Anytime Minutes.
- Operator Assisted calls are charged 100 Anytime Minutes for each minute used.
- Call Forwarding calls are charged an additional three Anytime Minutes for each minute used.
- Text Messaging are charged one Anytime Minute for each text message sent or received.
You are responsible for any taxes or surcharges.
Minimum Balance:
You must maintain a minimum balance of 10 Anytime Minutes and 1 Access Day to avoid service suspension. Calls or average usage that will reduce or are likely to reduce your Anytime Minutes below the minimum balance will result in suspension of your service. Upon loading another EZlinkVIP product that brings your account balances above the minimum balances, your service will be restored with no extra fees, and any unused Anytime Minutes will carryover. Anytime Minutes that are not used within 120 days from initial load will be forfeited. If your account is suspended for more than ten consecutive days due to insufficient Anytime Minutes, or due to insufficient Access Days, your service will be disconnected. Upon disconnection, your Anytime Minute balance, Access Days balance, and phone number will be forfeited.
Restrictions & Limitations:
Unlimited Nights & Weekends is available from 9 p.m. – 7 a.m. Monday through Thursday, and from 9 p.m. Friday to 7 a.m. Monday local time for local calls within the Home Calling Area only. Hours other than Unlimited Nights & Weekends are considered the Daytime Calling Period. Unattended calls and calls involving features listed above are not included in Unlimited Nights & Weekends and are chargeable. Three way calling, caller ID, Text (SMS) Messaging, operator assisted calls, and other features may not be available on your handset, the service or in your calling area. Calls to certain telephone numbers or regions may be restricted (including calls to 500, 700, 900 or 976 numbers). Your handset (including the subscriber identity module or “SIM”) will be restricted to EZlink services enabled by DBS Communications, Inc. (DBS), and cannot be activated on any other wireless service. You agree not to tamper with or alter your handset or its software, enter unauthorized PIN numbers, or engage in any other unauthorized or illegal use.
Service Cancellation, Limitation of Liability and Other Terms:
Your service, and account balance, may be refused, suspended or cancelled with or without notice for reasons of illegal activities such as fraud or theft of services, or if we in our sole discretion believe that you have violated these Terms and Conditions or our policies, or cannot pay any charges for service, or for abuse of the service (including excessively long or unattended calls, or by calling destinations not explicitly allowed by the EZlinkVIP card or using equipment that may interfere with our network or service to customers), or for utilizing the service for other than for its intended purpose. We reserve the right to offer you a different calling plan in the event of excessive use. The value indicated on this card is not refundable or transferable. Once a service option is selected and activated for an EZlinkVIP card, it cannot be changed or refunded. Service rates, minute denominations, additional fees and other terms are subject to change without notice at our sole discretion. The Terms and Conditions of other EZLink products may apply or supersede these Terms and Conditions. Other restrictions apply. DBS is not responsible for lost or stolen cards, or unauthorized use of services described on the card, or for any interruption of telecommunications services. If your phone is lost or stolen, please visit the nearest retail location to have your phone suspended temporarily. The coverage map is an approximation of coverage, and actual wireless coverage may not be available in all areas within the coverage map. Your wireless services may be affected by network outages and weak signal conditions, and will not be available in all locations or at all times. DBS shall not provide any credit for dropped or interrupted calls. DBS may use any carrier to provide services and may change any of its service providers without notice. DBS shall not be liable for any claims relating to any products or services whether or not provided by DBS. We may contact you on your EZlink wireless phone to notify you when your balance is low and to inform you of new product and promotional offers. EZlinkVIP is provided only by DBS and its authorized retailers. |
